Of course! But then your eligibility comes down to the registered capital, which is having 2 million baht as that will let you employ a foreign national. Besides, a further 2 million baht each person will be required in order to hire up to 10 people. However, in order to let the foreigner work in your company you must grant a Thai work permit. And since this is in a discretionary basis, it will consider the suitability and qualifications of the foreign for the job title.

Some conditions (other than the above) for you to hire a foreigner are explained below;

  • If in case the registered capital is less than 2 million baht the company will be eligible to hire only 1 foreigner after at least 5 million baht total Corporate Income Tax in Thailand payment has been made in the past three years. Your company will have the authority to hire 1 foreigner for every 5 million baht paid in tax.
  • You (employer) have been engaged in export that has brought into Thailand revenue of 3 million baht in the past fiscal year. Therefore, you will be able to hire 1 foreigner for each additional 3 million baht b for up to a maximum of 3 people.
  • You (employer) should employee “at least 50 Thai employees per foreign employee up to a maximum of 5 foreign employees.”

On the other hand, a foreign employee must also have paid personal income tax in the last year. If the foreign employee has not been employed in Thailand previously, then the potential employer must provide documents to confirm that the foreign employee will derive income in Thailand in the near future.
