work permit requirement in thailand

To process a work permit for ex-pats who work for a BOI company in Thailand, the company must first register in the BOI E-expert system online. It is here where you may then apply for a work permit for your foreign employees, experts, and specialists, as well as extend their work visas. Although your work permit requirement in Thailand may vary depending upon your nationality and purpose in the kingdom, yet, this article will guide you to obtain one to work for a BOI Company.

In terms of the paperwork required for the processing of a BOI work permit, we’ll assume that your new employer is a BOI business that has already requested that the BOI authorize your new employment.

Work Permit Process for BOI Company in Thailand

  • The BOI company submits an application for BOI permission to engage foreigners for specific job opportunities. So, in case of disapproval of one position, the organization will have to repeat this step for the position. In other situations, the BOI firm may have previous approval for all of the positions, including yours. Therefore, you will be able to bypass this stage. This procedure takes 3-5 business days.
  • The BOI company requests from the BOI a visa letter for the ex-pat employee to present to a Thai embassy abroad. This can take 1-3 business days. The firm can then print the letter and include it with the expat’s visa package when you apply for a non-immigrant “B” Visa.
  • A Visa package must have a cover letter to the embassy or consulate, a Visa application form, two photographs, and the company’s documentation. Additionally, there can be a certificate of incorporation, a Memorandum of Association, a Company Affidavit, a List of shareholders, a VAT registration certificate, and VAT returns from the latest 3 months. If your business isn’t brand new, you’ll also need to send a copy of the most recent year’s audited financial statements and corporate income tax return.
  • The company applies to the BOI to hire the ex-pat into the role from step 1 after the ex-pat returns to Thailand with a nonimmigrant Business Visa. It takes roughly 3-5 business days for this to happen. At this point, the ex-pat must present his education and job experience certificates.
  • The company prepares the forms for the ex-pat to apply for a work permit and a visa extension.
  • The company takes the ex-pat to the BOI’s one-stop service to obtain a work permit book and renew his visa for another 1–2 years. At the one-stop service location, this normally takes the entire day.

How do we process your BOI Company Work Permit Requirement?

Here’s what we’ll do if we’re hired to process your work permit requirement in Thailand for a BOI Company. We will construct a visa package for you to take to the Thai embassy in your company. However, this is to apply for your Non-immigrant B visa after the position gets BOI approval. Here’s what we’re looking for from you:

  1. A copy of the Passport – only the biodata page
  2. The Thai embassy address where you intend to apply for the visa. We need this so that we can prepare a cover letter for the embassy.

Once you receive the visa package through email from us, you must complete the online visa application form. This is for the Thai embassy/consulate where you wish to apply for a visa. While filling out the form, you may have questions, which you can always ask us.

You must upload a WP3 certificate from the Thai Labour Ministry. You need not worry about it. Instead, upload our visa package, which includes all of the documentation.

After completing all of the formalities for entering Thailand, you have the Immigration official put “Non-B” on his entrance stamp. This is because the immigration officer frequently overlooks the visa sticker page and assumes the ex-pat is entering the country without a visa.

Documents Submission on Reaching Thailand

Now, once you arrive in Thailand, we need the following documents from you:

  1. Copy of passport (Bio page, visa sticker page, last entry page, and departure card)
  2. Photo (in business attire) in .jpg format
  3. Copy of your highest education degree – If it is not in English, we need a translation attached to it too.
  4. Work experience certificate or letter from your ex-employer(s). It must show at least 2 – 5 years of experience in the same field for which you got BOI approval. If your degree is directly related to the position, you need 2 years of experience. If your degree is not related, you need to have 5 years of experience.
  5. Address in Thailand, Phone number, and Email address
  6. Work permit cancellation letter from Labor Department (if any)
  7. 90 days report (if any)
  8. Copy of old work permit (If any)
